1. Agreement to Terms

By accessing or using Inktastic ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 16 years old to use Inktastic. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the security of your account credentials. Do not share your password with others. You are responsible for all activity that occurs under your account. Notify us immediately at letstalk@inktastic.net if you suspect unauthorised access.

4. Intellectual Property — Yours

You retain full ownership of all manuscript content, book files, and creative work you upload to or create with Inktastic. By uploading content, you grant Inktastic a limited, non-exclusive licence to store, process, and format your content solely for the purpose of providing the Service to you.

We will never claim ownership of your work, publish your content without permission, or use your manuscripts to train AI models without your explicit, opt-in consent.

5. Intellectual Property — Ours

Inktastic's platform, software, algorithms, design, trademarks, and documentation are owned by Inktastic Ltd and protected by copyright and intellectual property law. You may not copy, modify, reverse-engineer, or create derivative works from any part of the platform without written permission.

6. Acceptable Use

You agree not to use the Service to:

• Upload content that infringes the intellectual property rights of others
• Upload content that is illegal, defamatory, obscene, or harmful
• Attempt to gain unauthorised access to other accounts or platform systems
• Use automated scripts, bots, or scrapers against the platform without written permission
• Resell or sublicense access to the Service without prior agreement
• Circumvent, disable, or interfere with platform security features

7. Subscriptions & Payment

Paid subscriptions are billed monthly or annually in advance. All prices are listed in USD unless otherwise stated and are exclusive of applicable taxes. Subscriptions renew automatically unless cancelled before the renewal date.

Inktastic reserves the right to change pricing with 30 days' notice. Price changes apply at your next renewal date. You may cancel before the renewal to avoid the new price.

8. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then. We offer a full refund within 7 days of any new subscription or annual renewal charge. Refunds after 7 days are at our discretion.

9. Service Availability & Changes

We aim for 99.5% uptime and will give at least 14 days' notice of any significant changes to or discontinuation of the Service. We are not liable for temporary unavailability caused by maintenance, third-party outages, or events beyond our reasonable control.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on severity. Upon termination, you may request an export of your content within 30 days. After this period, content may be permanently deleted.

11. Limitation of Liability

To the maximum extent permitted by law, Inktastic shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts. If you are a consumer in the EU, you may also rely on mandatory consumer protection provisions of your country of residence.
